PLEASE read the below Terms and Conditions carefully. It includes important information about costs, fundraising targets and potential penalties if the fundraising target is not reached.

Sailors� Society Terms and Conditions for London Marathon 2025 MyWay Participants

Definitions:
�Sailors� Society/We/Us/Our� means Sailors� Society (registered charity number : 237778) Seafarer House, 74 St Annes Rd, Southampton SO19 9FF. The charity that has reserved Your place in the Event.

�You/Your/Yourself� means the person agreeing to be bound by these terms and conditions and who is using a Sailors� Society place to take part in an Event.

�Event� means the TCS London Marathon MyWay 2025.

�Event Organiser� means the company TCS London Marathon Events responsible for organising the TCS London Marathon MyWay.

�Fee� means the registration fee that You are required to pay to confirm Your place in the Event.

1. Participation 

1.1. You acknowledge that participation in the Event may be physically demanding, and You are aware of the nature of the Event and associated medical and physical risks involved.

1.2 You agree that You are physically capable of taking part in the Event and agree to be solely responsible for Your actions. Sailors� Society is not responsible for any injury or illness that You may suffer as a result of Your participation in the Event. 

1.3 The minimum age of entry is 18 years at the date of the event.

1.4 You will have 24 hours to participate in the Event from 00:00 to 23:59 on Sunday 27th April 2025. Activities outside of this window will not count towards Your participation. You will only receive Your finishers� medal and t-shirt from the Event Organiser if Your participation is within this window.

1.5 You may participate in this Event from a location of Your choosing. This includes, but is not limited to local neighbourhoods, onboard ship, on a treadmill, racing tracks, in docks or along the coast.

2. Bookings, Payments and Your obligations

2.1 You shall complete the Sailors� Society Registration Form and submit payment of the Entry Fee of �40.00.

2.2 You shall not be eligible or entitled to participate in the Event and no binding contract shall exist between You and Us until We have provided You with written confirmation that the registration was successful and full payment of the Fee has been received.

2.3 You shall complete the Event Organiser�s Confirmation when it is sent to You by email after Registration is complete and full payment of the Fee has been received.

2.4 In order to take part in the Event, You pledge to raise money for Sailors� Society. The minimum fundraising target for a Sailors� Society place in the Event is �250.00 (excluding Gift Aid). You pledge to have secured 80% of the minimum sponsorship (�200.00) amount at least 6 weeks (16th March 2025) before the Event. You agree to pay all sponsorship monies to Sailors� Society by the end of the 6th week after the event (8th June 2025). If this money is not paid, Sailors' Society will invoice you for the balance and You will not be permitted to take part in any fundraising event for Us for 12 calendar months.

2.5 Employer match funding is excluded from the minimum fundraising target.

2.6 You also agree to:
a)	Comply with any rules or regulation relating to the Event as We or the Event Organiser may notify You of from time to time.
b)	Follow all instructions given by Us, the Event Organiser and any of Our or the Event Organiser�s agents, employees or workers, or any referees, stewards or other officials in respect of the Event.

3. Withdrawal, Cancellations or Deferrals

3.1 The Fee is non-refundable, as Sailors� Society Event places are limited and payment of the Fee and reservation of the place has an effect on expenditure and income for the Event. Discretionary refunds will ONLY be provided in limited circumstances such as:
a)	The Event is cancelled by the Event Organiser (provided that We receive a refund on Our costs from the Event Organiser for the relevant places in the Event).
b)	You have notified Us no less than eight weeks before the Event (23rd February 2025) of your request to withdraw or defer Your place for reasons beyond your reasonable control, as pursuant to Clause 3.2. This will allow Us enough time to reallocate Your place.
c)	Withdrawal of deferred places will NOT receive a refund.
d)	Our refusal of Your registration or cancellation of Your place in the Event; the circumstances for refusal are set out in Clause 3.4.

3.2 Your withdrawal and deferral allowances for the Event are as follows:
a)	Withdrawal OR Deferral is permitted if an injury has occurred or Your physical or mental health has declined to an extent which will limit Your ability to participate in the Event.
b)	Withdrawal OR Deferral is permitted if other personal circumstances arise which will limit Your ability to participate in the Event.
c)	Withdrawals will result in your forfeiture of Your place in this year�s Event. Withdrawal does not affect Your candidacy for the following year�s Event.
d)	Deferrals to the following year�s Event may ONLY be provided if such Event takes place and such deferrals are permitted by the Event Organiser. 
e)	You shall only be entitled to defer your place ONCE. The only exception to this is if You are pregnant or postpartum, where You are entitled to defer Your place to one of the following three years.

3.3 Notice of withdrawal or deferral must be communicated by emailing Sailors� Society, or by writing to Development Coordinator, Sailors� Society, Seafarer House, 74 St Annes Rd, Southampton SO19 9FF. Withdrawals and deferrals MUST be agreed in writing. 

3.4 Sailors� Society reserves the right to refuse Your registration or cancel Your place in the Event if:
a)	We consider that You are incapable of participating in the Event without endangering Yourself or others.
b)	We consider that Your participation in the Event will bring the Event, the Event Organiser or Sailors� Society into disrepute or otherwise damage the reputation of Sailors� Society, the Event or the Event Organiser.
c)	You fail to raise 80% of the minimum fundraising target by the deadline set out in clause 2.4 above, without first having a discussion with the Development Coordinator.
d)	You failed to raise the minimum fundraising target for a different Sailors Society Event by the agreed deadline in the past 24 months.

3.5 Your place in the Event is personal to You and You may not transfer it (or any of Your other rights or obligations) to any other person without our prior written consent. Transfer will only occur with the consent of the Event Organiser. We may refuse such a transfer where it is reasonable for Us to do so.

4. Publicity and Results 
4.1 By completing this Registration Form and taking part in the Event, You hereby irrevocably grant Sailors� Society such exclusive right (at no cost) to do the following throughout the world:
a)	Quote and/or Interview You before, during and after the Event, as Sailors� Society may reasonably require in connection with the Event.
b)	Photograph and/or Film You before, during and after the Event, as Sailors� Society may reasonably require in connection with the Event.
c)	Use any material produced as a result of this right.

4.2 Whilst We will use reasonable endeavours to obtain Your express permission to use quotes, images, videos or recordings of You this is not always possible. We won�t be able to tell you when we use it, but it will never be in a demeaning or defamatory manner. You agree that We may use and/or reproduce any quotes, photos, videos or recordings of You which are taken before/during/after the Event for purposes related to the Event or the promotion of Sailors� Society.

4.3 Copyright and intellectual property will always remain with Sailors� Society.

5. Our responsibility for loss or damage suffered by You

5.1 You acknowledge that:
a)	You are taking part in the Event at Your own risk.
b)	Although we have carefully Selected the Event and the Event Organiser, Sailors� Society is not the organiser of the Event.

6. Data Protection

6.1 By completing this Registration Form, You agree that any personal information provided by You or collected about You in connection with the Event may be held and used by Us in relation to the Event and its promotion.

6.2 You also agree that the personal information provided by You may be shared with:
a)	The Event Organiser who may use it in connection with the organisation and/or administration of the Event or for other reasons associated with the Event.
b)	The media for reporting on the Event.

6.3 We will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with Our privacy notice (which can be found at https://www.sailors-society.org/privacy-policy).

6.4 You agree to inform Sailors� Society of any changes to the information supplied in this Registration Form as soon as possible.

6.5 We will be the data controller of the information which You provide Us or which we obtain in relation to the Event and the Event Organiser will be the data controller of any information which We pass on to them pursuant to clause 6.2.
